Please ensure you have read my terms and conditions before purchasing artwork, prints and ordering a commission.

COMMISSIONED PORTRAIT WORK

Deposits
A £50 non-refundable deposit is required to secure your portrait in my client waiting list. Clients will be advised of the approximate waiting list at the time of ordering. Portraits will not be deemed as ordered until the deposit has been received. Payment terms will be provided in writing prior to accepting your commission and receiving your deposit.

Payments
One week before I commence work on your portrait I will invoice you for 50% of the remaining balance. The remaining final balance will be invoiced upon completion and approval of the portrait and must be paid in full prior to your portrait being shipped.
Payments can be made securely online via bank transfer, Paypal or credit/debit card.

Cancellations
Clients have a 7 day money back guarantee from the date of paying their deposit to cancel their order, in which they will receive a full refund. Cancellations must be made in writing by email or direct message. Upon cancellation, clients will lose their place in my waiting list.
If clients cancel their order and 7 days have passed since placing the deposit, the full deposit amount will be retained as loss of business, to cover the artist’s time, administration, emails, mock-ups, payment fees. Any additional payment made by the client will be refunded in full.

If clients cancel their order and work has commenced on the portrait, the deposit plus 50% will be retained to cover the artist time, administration, materials used.
​
Changes and rejection of finished portrait
Once the portrait has been completed, the portrait will be emailed to you for your approval with the option of making any adjustments and alterations as far as the artist is able, in line with the client's original portrait expectations. On receiving an approved portrait, clients have 7 days to contact me about any required changes. Once the portrait has been delivered, if the portrait needs returning for further alterations the client must cover the necessary shipping charges both ways.

If the client is still not happy with the finished portrait after changes have been made, clients will receive a full refund minus the deposit plus 30% of the balance, plus the cost of any matting and framing that has been paid. The refunded amount will be paid after the portrait has been returned to me.
Framing
Due to the bespoke nature of framing, any framing/matting service required must be paid in full before the portrait is sent to be framed.

Loss/Damage in Transit
My portraits are packaged extremely well however in the unlikely event that damage occurs during transit please send a photo of the damaged artwork immediately. The artwork must be returned to us and a new portrait will be drawn at no cost. The new portrait will be added to my client waiting list.

You agree that proof of delivery supplied by the delivery couriers is evidence that your portrait has been received.
Lead Time
I often have a client waiting list and lead time will depend on the time of year and number of other portraits booked in my schedule. I will provide an estimated completion date upon your enquiry. For specific dates (e.g. for a birthday) I will try my best to accommodate any special request.
Delivery
The artist ships portraits worldwide using DHL, Parcel Force, Royal Mail, Hermes or UPS International depending on the destination. Delivery time is approximately 1-3 days within the UK and 3-15 days outside the UK.
Privacy Policy
The artist will not sell, distribute or lease your personal information to third parties.

SALE OF PRINTS
Shipping And Handling
Whilst every care has been taken to assure accuracy of reproduction of prints according to their originals, the artist cannot guarantee a 100% likeness due to scanning settings, individual monitor/screen settings.

Delivery Timescale
We ship print orders out twice per week. Prints will be packaged in several layers of sturdy/rigid packaging to avoid damage during transit. Prints are shipped either by Royal Mail, Hermes, DHL or UPS International. We endeavour to deliver within 5 working days or your order being placed.

You must inform us within 3 working days if the prints has been lost or damaged in transit so we can rectify the problem. You agree that proof of delivery supplied by the delivery couriers is evidence that your print has been received.
​
Back Orders
Should an item be out of stock, but an error on the website has stated the item is available, you print will be placed on back order (as long as a limited edition has not fully sold out). You will be emailed first with the option to cancel your order.

Credit Card Security
When your order is placed on the website, credit/debit card numbers are encrypted using 128 bit encryption.

Guarantee
Your satisfaction is guaranteed. All prints come with a 7 day no fuss guarantee.
​
Returns Policy
You are entitled to cancel your order and return your prints within 7 days. You are responsible for the cost of shipping and risk of loss/damage in transit. Your refund will be processed within 14 days. This cancellation policy does not affect your rights when your order has been received faulty or mis-described.

Certificates of Authenticity
All my original work comes with a certificate of authenticity.

Guarantee
I personally guarantee that my original drawings/paintings will last for many years to come. I use nothing but the highest grade archival materials in creating my artwork; using lightfast pencils conforming to ASTM D-6901 international lightfast certification and acid free archival cotton paper, both of which ensure that every drawing is ready to withstand the ages.
​
Paintings are created using the highest lightfast pigment paints and will be covered with a minimum of three layers of varnish for added protection.
​
Return Policy
Your rights to return artwork is protected under the EU Distance Selling Directive. If you are unsatisfied with your original artwork, you may return the work(s) within 7 days of receiving it. You must email claire.milligan@yahoo.co.uk for a return address. In order to receive a full reimbursement of your money, your item must be postmarked within 7 days of receiving your order. If the item is returned within this time-frame in the same condition as it was when shipped, you will receive a full refund of your purchase price (return postage will not be refunded). You agree that proof of delivery supplied by the delivery couriers is evidence that your work has been received.

Packaging and Shipping
I personally guarantee that my artwork will be packaged sufficiently enough so that damage is prevented as best as it can be during transit. I package all my original work myself in my studio with acid-free wrap and protected with several layers of sturdy packaging to form a solid box. Framed work will be protected further with corner protection, bubble wrap and shipped in a custom made sturdy box. I have shipped hundreds of works over the years and have yet to see any issues.

Shipping Timescale
Purchases of original artworks will be shipped within 5 working days or otherwise agreed by email. Many of my original works have sold before the artworks completion, so please allow for additional time for completion of the works, photography/scanning for artist reproductions/documentation, framing and other necessities. Some works may also be entered and displayed at exhibitions, the buyer will be notified of this and an agreed delivery date and a separate payment schedule will be confirmed in writing.

Loss/Damage in Transit
My original works are packaged extremely well however in the unlikely event that damage occurs during transit please send a photo of the damaged artwork and the package in which it was received, immediately, along with a description of the problem to claire.milligan@yahoo.co.uk. Your issue will then be reviewed and if it is determined that there is a problem during shipping, your item will be replaced with no questions asked.

You must inform us within 3 working days if the artwork has been lost or damaged in transit so we can rectify the problem. You agree that proof of delivery supplied by the delivery couriers is evidence that your work has been received.
​
Payment
Payment will be organised between the buyer and myself (the artist) and confirmed in writing prior to dispatch. Payment can be accepted by bank transfer, Paypal or credit/debit card. Payments by Paypal or credit/debit card will incur an additional 3% handling charge. Full payment plus any shipping charges must be be received before artworks are shipped.

COPYRIGHT
​
The artist retains full copyright on all artwork that is produced, including originals, mock-ups and prints. When an artwork is commissioned I reserve the right to display it on my website gallery and on my social media pages. Clients who do not wish their commissioned work to be shown online must notify me before work commences.

All images on this website are the sole property of Claire Milligan Art and are fully protected by the appropriate international copyright laws. The use of any images from this website without permission to advertise, reproduce or use in any manner is not permitted and Claire Milligan Art reserves the right to take full legal action upon anyone found doing so.
​
VAT & IMPORT DUTY
All items for sale including commissions are not subject to Value Added Tax. Payment of import duty may be liable in some countries, which is the sole responsibility of the client.

PRIVACY POLICY
Claire Milligan Art is committed to protecting your privacy. Customer information is solely used for the purpose of fulfilling orders and is never shared to any third parties. Email addresses provided by customers may be used in the future by Claire Milligan Art to notify them of special offers, updates and artist news, and will never be shared with anyone.

We may disclose your personal information if we are required by law to do so or if you violate our terms and conditions of service.
